The following changes may be made by completing the following forms or by contacting our Business Operations Center: Seller warrants that all goods delivered and services provided under this Agreement are free from defects in materials and workmanship and strictly in accordance with the specifications, drawings or samples specified or delivered. This warranty will survive any inspection, delivery, acceptance or payment by YMCA for the goods and/or services and extends to YMCA, its customers and any user of the goods and/or services. This express warranty is in addition to Seller`s implied warranties of merchantability and fitness for a particular purpose, which cannot be excluded.
Warranty periods do not begin until YMCA accepts the goods and/or services. This Order (this “Order”) is an offer to purchase the goods and/or services set forth at the beginning of this Agreement (the “Goods” and/or “Services”) and becomes a binding contract subject to the terms and conditions set forth herein if accepted by seller`s acknowledgment OR commencement of performance. Seller`s acceptance of the terms and conditions of this Order or Seller`s shipment or performance of any part of this Order constitutes acceptance of all of these terms and conditions of this Order and with respect to all related facilities with respect to YMCA`s purchase of the Triangle Zone. Inc. (“YMCA”) and these Terms and Conditions, together with any other written agreements signed by Seller and the YMCA`s Chief Financial Officer (or Agent) relating to the same subject matter as this Order, constitute the entire agreement (“Agreement”) between Seller and ymca. This Order may only be accepted under the exact terms set forth herein and no additional or additional Seller Terms that may appear in Seller`s offer, Seller`s confirmation, Seller`s invoice or any other Seller notice shall be deemed accepted or binding by the YMCA. YMCA hereby expressly disclaims all terms and conditions that supplement, modify or otherwise deviate from the terms of this order, and these terms will be superseded by the terms set forth herein, unless YMCA has expressly agreed in writing. Notwithstanding anything to the contrary herein, if any of the terms of this Order conflicts with any of the terms of any written agreement signed by Seller and YMCA relating to the same subject matter of this Order, the terms of the Agreement shall prevail. Changes to the schedule must be made online no later than Monday, one week before the week of care, to ensure accurate billing for the sessions you need. Additional fees apply for adding or changing sessions after the weekly timeout has expired. You will be charged your original schedule for the week, plus the additional session(s) and a $2 fee for late change per session. Parents are responsible for all payments and fees not covered by an authorization.
An expired authorization or non-payment of the co-payment may result in the termination of your child`s registration. County claim forms must be signed and returned to the Y within one week of receipt. Failure to provide a signed application form may result in the parent being responsible for the full cost of child care. You may contact The Y with any requests or complaints regarding the use of information about you. We will use reasonable efforts to respond to reasonable requests for access to data concerning the Applicant. We will also make reasonable requests to correct false or misleading information about the applicant. The following YMCA of greater Toronto Area locations currently offer emergency child care and registration is possible through your local community. A complete list of emergency child care facilities and locations can be found on your municipality`s website. While an industry standard Do Not Track (DNT) protocol has not yet been established, The Y`s information collection and disclosure practices and the choices it provides to consumers will continue to operate as described in this policy.
Membership Change: Members may request a change to their membership, including: YMCA may terminate this order for cause without further obligation to seller due to a material breach of seller`s terms and conditions. Ymca may, in its sole discretion and without waiving its rights under law or equity, grant the Seller a reasonable adjustment, taking into account the Contractor`s time, effort and damages associated with the breach. .
